{"id":877,"date":"2017-12-15T06:48:05","date_gmt":"2017-12-15T09:48:05","guid":{"rendered":"http:\/\/www.tierraamarillainforma.cl\/?p=877"},"modified":"2017-12-15T06:48:05","modified_gmt":"2017-12-15T09:48:05","slug":"municipio-enfrenta-mas-30-demandas-ex-trabajadores","status":"publish","type":"post","link":"https:\/\/tierraamarillainforma.cl\/cv\/2017\/12\/15\/municipio-enfrenta-mas-30-demandas-ex-trabajadores\/","title":{"rendered":"Municipio de Tierra Amarilla enfrenta m\u00e1s de 30 demandas de ex trabajadores"},"content":{"rendered":"<h5 style=\"text-align: justify;\">Los ex funcionarios a honorarios estar\u00edan pidiendo sumas millonarias de dinero, acusando despido injustificado<br \/>\n.<\/h5>\n<p style=\"text-align: justify;\">Son 38 demandas que interpusieron ex funcionarios a honorarios de la municipalidad de Tierra Amarilla contra la casa consistorial, apeg\u00e1ndose a una jurisprudencia de la Corte Suprema. el edil suplente de la comuna, Mario Morales se\u00f1alo que acatar\u00e1n lo que el Juzgado de Letra del Trabajo determine.<\/p>\n<p style=\"text-align: justify;\"><strong>CONTEXTO<\/strong><\/p>\n<p style=\"text-align: justify;\">El 31 de agosto fueron desvinculados, por t\u00e9rmino de contrato, m\u00e1s de 160 funcionarios a honorarios, siendo un grupo de ellos quienes demandan al municipio.<\/p>\n<p style=\"text-align: justify;\">Desde el Departamento jur\u00eddico indicaron que estos trabajadores estaban contratados bajo la administraci\u00f3n del anterior alcalde y cuando asumi\u00f3 Morales (actual edil) se dieron cuenta que no ten\u00edan disponibilidad presupuestaria para renovar los contratos y no hab\u00edan recursos para cancelar el sueldo de los trabajadores durante el tiempo que hab\u00edan sido contratados. A ra\u00edz de ello, en concejo municipal se aprob\u00f3 la modificaci\u00f3n presupuestaria de 121 millones con el objetivo de hacer efectivo el pago de los sueldos de estas personas.<\/p>\n<p style=\"text-align: justify;\">\u00abTodas estas personas que fueron contratadas por la administraci\u00f3n anterior, el contrato fue fuera del marco legal, fue por eso que tuvimos que reunir el consejo en pleno para que sea aprobada la modificaci\u00f3n presupuestaria correspondiente para poder dar paso a pagar estos compromisos que se hab\u00edan adquirido fuera de la legalidad (&#8230;) no se volvieron a contratar porque no estaban los recursos\u00bb, especific\u00f3 el alcalde (s) Mario Morales.<\/p>\n<p style=\"text-align: justify;\"><strong>DEMANDA<\/strong><\/p>\n<p style=\"text-align: justify;\">Un grupo de estas personas disconformes con la situaci\u00f3n, demandan al municipio por nulidad del despido, despido injustificado y el cobro de prestaciones laborales ante el Juzgado de Letras del Trabajo en Copiap\u00f3. Cada una de ellas estar\u00eda pidiendo, en promedio, alrededor de 10 millones.<\/p>\n<p style=\"text-align: justify;\">Demanda que interpusieron apeg\u00e1ndose a una jurisprudencia de la Corte Suprema, en que bajo ciertas y determinadas circunstancias, se estima que ciertos y determinados honorarios est\u00e1n protegidos como si fueran contratos de trabajo, aclararon desde el Departamento jur\u00eddico.<\/p>\n<p style=\"text-align: justify;\">\u00abEstamos recibiendo las notificaciones de las demandas lo que vamos a hacer es un estudio caso a caso sobre cu\u00e1l es la situaci\u00f3n de los contratados a honorarios y sobre la base de ese estudio se van a ir contestando todas y cada una de las demandas. En definitiva Esperamos que el tribunal laboral nos de la raz\u00f3n y no condene a la municipalidad a pagar estas cifras de dinero porque son muchas personas y cifras muy altas, eso puede significar que la municipalidad se quede sin recursos para cubrir programas sociales\u00bb, se\u00f1al\u00f3 el asesor jur\u00eddico de la municipalidad, Carlos P\u00e9rez.<\/p>\n<p style=\"text-align: justify;\">Al respecto, el alcalde suplente, Mario Morales agreg\u00f3 que \u00abest\u00e1n todos los temas judicializados, la municipalidad va a defender los recursos y los trabajadores tienen el derecho de poder apelar las instancias correspondientes (&#8230;) nosotros somos respetuosos de los poderes del Estado, as\u00ed que acataremos todas las instancias correspondientes que termine la justicia.<\/p>\n<p style=\"text-align: justify;\">.<br \/>\n.<br \/>\nFuente: Diario Atacama (09-12-2017) \/ Daniela Munizaga<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Los ex funcionarios a honorarios estar\u00edan pidiendo sumas millonarias de dinero, acusando despido injustificado .
