El m\u00e1ximo tribunal desestim\u00f3 las alegaciones presentados por la empresa y confirm\u00f3 la resoluci\u00f3n de la Superintendencia de Medio Ambiente.<\/strong><br \/>\n<span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">La Corte Suprema rechaz\u00f3 los recursos de casaci\u00f3n presentados por minera Maricunga y confirm\u00f3 la sentencia del Segundo Tribunal Ambiental que hab\u00eda ratificado la sanci\u00f3n aplicada por la Superintendencia de Medio Ambiente (SMA, consistente en la clausura de los pozos de extracci\u00f3n de agua del Proyecto Minero Refugio, por el manejo inadecuado de los impactos medioambientales.<\/p>\n<p style=\"text-align: justify;\"><strong>CONTEXTO<\/strong><br \/>\nEn el procedimiento sancionatorio indicado, la SMA en 2016 concluy\u00f3 que la compa\u00f1\u00eda no cumpli\u00f3 con sus obligaciones de dar aviso y de adoptar las acciones necesarias e id\u00f3neas para hacerse cargo de los impactos ambientales no previstos, consistentes en la disminuci\u00f3n del nivel fre\u00e1tico en la cuenca Pantanillo-Ci\u00e9naga Redonda, y el consecuente desecamiento de a lo menos 70 hect\u00e1reas de humedales del Complejo Lacustre Laguna del Negro Francisco y Laguna Santa Rosa, el cual adem\u00e1s corresponde a un \u00abSitio Ramsar\u00bb (humedales con un importante n\u00facleo de diversidad biol\u00f3gica).<\/p>\n<p style=\"text-align: justify;\">Por esa raz\u00f3n, la SMA orden\u00f3 la clausura parcial de los pozos de extracci\u00f3n. El caudal autorizado fij\u00f3 niveles de extracci\u00f3n diferenciados por mes, considerando s\u00f3lo el agua necesaria para asegurar la recirculaci\u00f3n de soluci\u00f3n en las pilas de lixiviaci\u00f3n y el agua fresca para los trabajadores que deben permanecer en la faena de forma preventiva.<\/p>\n<p style=\"text-align: justify;\">La empresa reclam\u00f3 contra la resoluci\u00f3n que aplic\u00f3 la sanci\u00f3n de clausura, alegando ilegalidad de la misma por una serie de supuestos errores t\u00e9cnicos y jur\u00eddicos, todo lo cual fue desestimado por el Segundo Tribunal Ambiental y la Corte Suprema.<\/p>\n<p style=\"text-align: justify;\"><strong>EMPRESA\u00a0<\/strong><br \/>\nEste medio se contact\u00f3 con la empresa Kinross, operadora a cargo de la mina, para obtener sus impresiones tras la sentencia emanada por la Corte Suprema, pero no hubo respuesta hasta el cierre de esta edici\u00f3n.<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">70 Hect\u00e1reas de humedales aproximadamente, se vieron afectadas.<\/p>\n<\/blockquote>\n<p>.<br \/>\nFuente: Diario Atacama<br \/>\n&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>SENTENCIA.
