{"id":1816,"date":"2018-07-11T10:23:06","date_gmt":"2018-07-11T14:23:06","guid":{"rendered":"http:\/\/www.tierraamarillainforma.cl\/?p=1816"},"modified":"2018-07-11T10:23:06","modified_gmt":"2018-07-11T14:23:06","slug":"tribunal-oral-denuncio-carabineros-parte-policial","status":"publish","type":"post","link":"https:\/\/tierraamarillainforma.cl\/cv\/2018\/07\/11\/tribunal-oral-denuncio-carabineros-parte-policial\/","title":{"rendered":"Tribunal Oral denunci\u00f3 a carabineros por parte policial"},"content":{"rendered":"<h5 style=\"text-align: justify;\">Se trata de un caso de homicidio en el que los jueces cuestionaron el documento.<br \/>\n<span style=\"color: #ffffff;\">.<\/span><\/h5>\n<p style=\"text-align: justify;\">El Tribunal Oral en lo Penal ofici\u00f3 al Ministerio P\u00fablico con car\u00e1cter de denuncia los antecedentes de un homicidio ocurrido en Tierra Amarilla debido a que hab\u00eda <strong>una falta de precisi\u00f3n en el parte policial.<\/strong><\/p>\n<p style=\"text-align: justify;\">El hecho ocurri\u00f3 en un sector ubicado a un costado de la costanera de Tierra Amarilla, a la altura de la calle Margarita Rocco, lugar en que Francisco Erazo Pizarro apodado como el \u00abEl Chily Willy\u00bb sostuvo una discusi\u00f3n con la v\u00edctima, Manuel Villal\u00f3n conocido como \u00abEl Pico de Pato\u00bb, cuando ambos estaban ebrios.<\/p>\n<p style=\"text-align: justify;\">Con las diligencias solicitadas por la Fiscal\u00eda a la Brigada de Homicidios de la PDI, Erazo Rojas agredi\u00f3 con golpes de pu\u00f1os y luego con una piedra en el rostro a Villal\u00f3n G\u00f3mez, esto hizo que la v\u00edctima cayera al lecho del r\u00edo. \u00abA partir de estos hechos la Fiscal\u00eda de Atacama logr\u00f3 reunir prueba cient\u00edfica para poder reconstituir lo ocurrido, particularmente con los peritajes del Servicio M\u00e9dico Legal que establecieron que la causa de muerte fue asfixia por inmersi\u00f3n. Lo que vino a sustentar las versiones reunidas por personal de la PDI en cuanto a que el condenado mantuvo la cabeza sumergida de la v\u00edctima\u00bb, dijo el fiscal Christian Gonz\u00e1lez.<\/p>\n<p style=\"text-align: justify;\">El primer juicio por este caso se realiz\u00f3 en abril de este a\u00f1o, instancia en que se conden\u00f3 a Francisco Erazo Pizarro como autor consumado de homicidio. Oportunidad en que su defensa present\u00f3 un recurso de nulidad ante la Corte de Apelaciones de Copiap\u00f3, el cual fue acogido por lo que se determin\u00f3 la repetici\u00f3n de la audiencia de Juicio Oral.<\/p>\n<p style=\"text-align: justify;\">En este segundo juicio el mismo imputado fue condenado como autor del delito de homicidio simple, a quienes los Jueces aplicaron una pena de cinco a\u00f1os y un d\u00eda de presidio. Sanci\u00f3n que ser\u00e1 cumplida en la c\u00e1rcel de la capital regional.<\/p>\n<p style=\"text-align: justify;\"><strong>PARTE POLICIAL\u00a0<\/strong><br \/>\nSeg\u00fan los detalles que se conocieron en la sentencia, los jueces cuestionan apreciaciones que hay en el parte policial. <strong>\u00abFrancisco Javier Erazo Gonz\u00e1lez no presentaba incoherencia al hablar, ni tampoco inestabilidad al caminar<\/strong>, <strong>tal como daba cuenta el parte policial<\/strong>, lo cierto es que ninguno de estos cuatro polic\u00edas redact\u00f3 o firm\u00f3 el parte policial en que ello se consignaba, por lo que aparece como evidente que no pueden hacerse cargo de dichas aseveraciones que no fueron proferidas por su parte\u00bb.<\/p>\n<p style=\"text-align: justify;\">Posteriormente, los jueces indican que \u00absi bien los Carabineros que declararon en juicio dieron a entender que fue otro funcionario quien redact\u00f3 el parte policial, lo cierto es que aseguraron que siempre que existe un estado de ebriedad se pone a todo evento que se presentan dichas caracter\u00edsticas, aunque no existan, lo cual evidentemente puede resultar una falsedad, tal como en el presente caso\u00bb.<\/p>\n<p style=\"text-align: justify;\"><strong>Sin embargo, se acredit\u00f3 que el acusado al momento de la ocurrencia de los hechos se encontraba en estado de ebriedad, la alcoholemia practicada momentos despu\u00e9s de la ocurrencia del homicidio dio como resultado 2,25 por mil de alcohol en la sangre<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Los magistrados consideran que este tipo de situaciones no deben volver a repetirse, ya que podr\u00eda configurarse un il\u00edcito y una responsabilidad administrativa. \u00abSe ordenar\u00e1 oficiar en car\u00e1cter de denuncia al Ministerio P\u00fablico por esta situaci\u00f3n, como asimismo, al general de Zona de Carabineros de Chile de la III Regi\u00f3n de Atacama, para los efectos de indagar respecto a la eventual responsabilidad disciplinaria que podr\u00eda existir por parte de quien o quienes confeccionaron y suscribieron dicho parte policial que conten\u00eda antecedentes falsos\u00bb.<\/p>\n<p>.<br \/>\nFuente: Diario\u00a0 Atacama \/Redacci\u00f3n\/P.V\u00e1squez<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Se trata de un caso de homicidio en el que los jueces cuestionaron el documento. .
